What are the steps to follow on applying a green card with my second marriage?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Your question presents complex facts that require a consultation with an immigration attorney for a full legal analysis and advice. Such a consultation should address such things as documentary evidence of the bona fide nature of your first marriage notwithstanding that you did not live with your wife for approximately two years after your wedding; whether removal proceedings were commenced when you failed to timely file a Petition to Remove Conditions; how long you may have been unlawfully present in the U.S.; etc. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

Hello,   It is not clear from your question if you were ever convicted as a result of these arrests or when you first obtained your green card. This is information which is very important when you wish to submit an application with the USCIS for it lets one know if you will be eligible for naturalization and also, to ensure that you do not inadvertently end up in deportation proceedings due to your criminal convictions. The USCIS will review the past five (or three years if you got your green card through marriage and are still married to your U.S. citizen spouse) in particular to see if you are of good moral character. If one's arrests fall outside of the 3 or 5 years preceding your application, then it is possible to file for naturalization without worry.   Notes: This information is of a general nature and is not, nor is it intended to be legal advice. You should consult with an attorney for specific advice for your case.

What is the best legal way to settle in the US?

Answered by attorney Alena Shautsova

It depends on your qualifications and circumstances. Some people use family option, some employment. There are other ways but you should speak with an attorney.
