How can I divorce a green card holder?

default-avatar
Answered by attorney Lisa Ellen Seifert (Unclaimed Profile)
Immigration lawyer at Seifert Law Offices PLLC
If you file for divorce, you will end your relationship with him. There is no direct consequence that involves immigration. He might need help to determine what his options are, but for you you don't have any reason to worry about his immigration status. You are probably his sponsor on the I-864. Divorce does not change that fact. Good luck.

Can I file i-485 for my brother while his i-130 is still pending?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
An I-485 adjustment of status application requires that the priority date be current at the time of filing. For the month of February 2020, U.S.C.I.S. is using the dates of filing chart which is currently up to 7/22/07. Therefore even if your brother was here, he would not be eligible to submit an I-485 application. I do not see that there is a long-term visa available to your brother to help take care of your elderly parents. He may be able to apply to come to visit them, but that would be pursuant to a visitors visa. Can sponsor call police and U.S Ambassador to investigate or expel me

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
As long as you are still enrolled in school, there is no legal basis for you to have to return to your home country.   The threat to have you deported is an empty threat.
