If the petitioner's immigration status is holding up your case, he should apply for naturalization immediately. To qualify, he has to be a person of good moral character and a permanent resident for at least the last 5 years. The application is filed on form N-400 and the fee is $680.

There is no fixed date that an individual has to wait to remarry and sponsor a new spouse for immigration. However, U.S.C.I.S. will examine each case to see whether it believes that the marriage is bona fide.The penalties for marriage in which individuals are marrying for-profit or even to do a favor for the other party are $250,000 and/or five years in a federal prison for both parties where fraud is proven.
