Many people immigrate to the States by having the principal alien come first for a variety of reasons, and there is no disadvantage to having your father follow within the six months that he is given on the immigrant visa. There should be no issue with your mother and your sister coming in first. Neither would there be an issue with your father coming in later. The only rule of Immigration in this regard is that the dependent cannot precede the principal alien to the United States.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Yes, it would be helpful for the parents to provide any supporting information showing a good-faith marriage.

Can I sponsor my daughter and her family if they have a B2 holiday visa?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
You can sponsor but if your daughter is over 21 or she is married then there is a two-step procedure and you can only file the first step now and then wait for a visa to be available. Unless your daughter can change to another nonimmigrant classification for which she is eligible she will need to return overseas to await her visa. If you would like to consult on their cases, schedule an appointment with my office. We do charge for consultations but whatever is paid for the consultation would then be a credit toward the fees for her case if we are retained to do work after the consult.
