My wife's visa application status was just updated to " return to NVC" what does that mean for us? She's already had her interview

Answered by attorney Giselle Ayala Mateus
Immigration lawyer at G.A.M. Law Office P.C.
Yiu should contact the NVC or have an attorney help you. Of after an interview a case goes back to the NVC may be there is a problem. It may be also necessary to have more information about the interview, how did it go, etc.

Will I get a visitor visa if my husband is a green cardholder?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
Tell the consular officer exactly what the situation is. Explain that you have no intention of staying in the U.S. at this time, because you have to finish your education, and have a job and family obligations. If the officer asks, tell him/her that yes, you do intend to join your husband in the U.S. after he becomes a citizen and gets his immigrant petition for you approved. Bring with you documents showing your enrollment at the university , your employment, and your family and community ties. Don't be afraid - the consular officer will sense it and decide that you are lying or hiding something. Remember that, whatever the outcome of this interview, you can live with it; so, there is no reason for fear. Don't be intimidated by the environment of the consulate; you are a good person, let your personality shine. By the way, after you get your visa, your husband should file the immigrant petitioin for you: processing of the petition takes time (5 to 14 months); the sooner it starts, the sooner it will be over. When your husband becomes a U.S. citizen, his petition will be upgraded to the Immediate Relative category.
