Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. How were you "illegally detained? Was there an ICE hold on you? Were you picked up by Ice for some reason? I suggest that you contact an experienced civil rights attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. (S)he would then be in a better position to analyze your case and advise you of your options.

How long can I-130 take to be approved?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
I-130 processing times vary depending upon a variety of factors. In general our straightforward case take from 3 to 6 months to get processed. The process for his green card is complex after the I-130 is approved but a competent immigration lawyer or attorney should be able to assist you/him with the process.

Exradtition treaties between countries vary.  I don't know what the treaty between the US and Mexico would say about this situation.
