What can I do if my spouse will not let me attend my immigration appointment?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
If you are a victim of domestic violence, domestic abuse or mental cruelty you can file and I-360 Self Petition. If approved, the I-360 replaces the I-130 petition filed by your husband and therefore you do not need him to be involved in the process. As to you fingerprint appointment, if you do not go your case will be denied. If you are in fear of your husband you should immediately remove yourself from the dangerous situation.

If he was deported before and came back without inspection, there is nothing that can be done for him.

How can I get my citizenship if I have domestic violence 6 years ago?

Answered by attorney Nathaniel D Shafer
Immigration lawyer at Natty Shafer Law
While Immigration does take into account your full criminal history, they primarily focus on the most recent five years. If you otherwise have good moral character, you may still qualify for U.S. Citizenship. Talk to an immigration attorney about your specifics.
