Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. Did you file any paperwork with USCIS or DHS to petition him for a green card? Have you divorced him yet? If you are still legally married to him and have not filed a petition to legalize his status, he cannot file a petition on his own behalf. If you are divorced, then he could legally marry someone else and have them petition for him. As far as your son is concerned, he cannot use your son to immigrate to the U.S. Only your son, after he has reached the age of 21, can file a petition for his father. I hope this helps.
