If your spouse was not deported from the US, he will not need a waiver to enter the US because of that issue. I'm not sure if it will be a factor in approving or denying the visa. He will eventually need criminal histories from all places where he lived for more than 6 months.

Yes, your brother will have to start from the beginning. A green card is nullified by deportation/removal. In addition, a waiver of the deportation/removal would have to be approved if your brother has not been outside the US for the required period of time. ICE can hold him and then bring him before an immigration judge to be deported. Besides your brother's overstay, his felony conviction could also be an additional ground to deport him and depending on what the felony charges are, may make him inadmissible from ever returning to the U.S.
