This gets complicated in that the consular official must 'presume immigrant intent' when reviewing a non-immigrant visa petition. If your brother can prove to the satisfaction of the consular official that he does not have immigrant intent, then he may be issued a visitor visa. The decision cannot be appealed. He may try to apply in six months for another visitor visa. Some people, who have relatives in the U. S., and really want to immigrant, should consider other dual intent visa options like an H1-b visa, when they have the proper background and employer. If you have any further questions about the process, and how you may help, then I strongly recommend an appointment with a competent and experienced immigration attorney before you do anything.

Assuming that your employer is not H1B capital send, you will need to apply for an H1B visa on or about April 1. The H-1B process requires that you file an LCA with the DOL and then The employer must petition for the H1B before the USCIS in the US.

Can I file for my husband to move to America if I receive disability?

If you are a Citizen and your husband is a foreign national and you receive disability you may be able to do an I-864 for him if you have sufficient assets. Alternatively, if you are not able to use your assets (even though you are getting disability) you can obtain the support for the I-864 of a joint sponsor. You will need to do an analysis about the way to proceed.
