Can my father be deported when he already has a release date?

Brian D Lerner
Answered by attorney Brian D Lerner (Unclaimed Profile)
Immigration lawyer at Law Offices of Brian D. Lerner
He will most likely be transferred to immigration detention for removal proceedings. Removal/Deportation Representation. It is critically important that you get qualified and expert representation for the deportation/removal hearings. The Government will try to get the deportation issued. Neither the Immigration Judge, nor the Trial Attorney are there to help you. There are different forms of relief available which could result the granting of Lawful Permanent Residence. However, this requires large applications to be prepared and the necessity to prepare for trial. My firm has done this for several years, and if done properly, there is a very reasonable chance that it will be successful. If not done properly, the deportation order will be issued and your current way of living in the United States will end and you will either be on the run or be forcibly removed from the United States.

Will my husband be deported back to Jamaica after coming to the US on a green card?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
Is his Mom a citizen as well? If he became a permanent resident, and his Mom became a citizen before his 18th birthday then he is likely a derivative citizen. Unless his stepfather adopted him he cannot derive citizenship from that relationship. He may be eligible for other relief from deportation even if he is not a derivative citizen so he should definitely consult with an immigration attorney ASAP. These are general answers only as I do not have the facts of his specific case and would have to consult with him to properly advise him.

Can I change my visa status from B2 to L1B while in the United States?

Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
You can file for a change of status, but the company would need to pay the filing fee and attorney fee, It's really better for you to come in with the blanket L visa, and have your vacation, then start work directly afterwards. Check with your company attorney.
