Do I need visa while my husband's green card application is pending?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Maintenance of status only has to do with an individual’s status when he or she is in the United States. USCIS has no interest in what a person does outside the States. For you to apply for an I-485 application, you need to be physically in the country. If in the country, you are required to maintain a legal status prior to filing for the I-485. After filing the I-485, you can choose to maintain a nonimmigrant status or rely upon the I-485 filing to stay legally in the States. I assume that you are not subject to a two-year foreign residence requirement because of your J-1 visa. Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. What happens to my petition when I turn 21?

Alan Rodolfo Diamante
Answered by attorney Alan Rodolfo Diamante (Unclaimed Profile)
Immigration lawyer at Law Offices of Alan R. Diamante APLC
You would have your own application. If your grandfather petitioned your parent and you reach 21 before there is a visa, we subtract the period that the actual petition took to get approved from your age. If it adds up to less than 21, you will be okay.

Hello. Typically, we have the petitioner/you file one and the joint-sponsor file their own as well. This will make it a little clearer for the gov't. If you have any questions, feel free to email anytime: harun@ksvisalaw.com
