Once I received my Green Card am I required to remain in the same job untill contract expires?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The United States frowns upon involuntary servitude and would not enforce the contract as a condition of your immigration. U.S.C.I.S. will of course want to see that you have not abused the immigrant visa process, and that you had a bona fide intention to take up the job on a permanent basis at the time that you received your permanent resident card. Staying in the position for 6 months after obtaining the green card is usually sufficient to ensure that you will have no future problems with Immigration. What your employer does in a state court to enforce the terms of the contract is a civil matter in which the U. S. government would have no stake.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Can I file another H1b while my Perm is in process?

Matthew Scott Kriezelman
Answered by attorney Matthew Scott Kriezelman (Unclaimed Profile)
Immigration lawyer at Kriezelman Burton & Associates, LLC
Yes you can. Although an H1B is a non immigrant visa, you are allowed to have dual intent. This means that you can enter on the H1B while still seeking to eventually become a lawful permanent resident of the United States.

What can I do if I have an incomplete K1 requirement

default-avatar
Answered by attorney Lisa Ellen Seifert (Unclaimed Profile)
Immigration lawyer at Seifert Law Offices PLLC
Hopefully when the petition is adjudicated, the CIS officers will notice these deficiencies and give you a chance to submit them in a Request for Evidence. However, sometimes, if it is the basic evidence that is missing (proof you are a US citizen and free to marry), an officer may deny for failure to qualify. Either is possible.
