You cannot remain in the U.S. while your father's I-130 is pending. The process will take not less than 11 years (much longer if you are from Mexico or from Philippines). If you stay in the U.S. illegally, you will not get a green card when your father's petition gets approved.

Immagration help I-130

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
Hello. There are many applications that are necessary to sponsor a spouse. The initial family petition is submitted along with biographical forms and documentation. The financial support will not be required until just prior to his interview at the US Embassy. You can have a joint sponsor, and they can use their assets for proof.  In order to better advise, I would need more information about your relationship and marital history. Thanks.
