Do I look bad if I file and do I need to be divorced?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Sorry to hear about your husband's abusive conduct and your need for a divorce. If you already have been a Permanent Resident for six years, you likely are eligible to apply now to become a naturalized U.S. citizen, and this is true regardless of whether your marriage terminated in divorce approximately six years after you adjusted status, and regardless of who is identified as the petitioner in a divorce proceeding. It would be wise for you to confer with an immigration attorney to address your immigration situation and eligibility for naturalization, and for you to confer with a domestic relations/divorce attorney about rights and responsibilities relating to a divorce. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

Can my husband still apply for a green card if the police only took his information, no fingerprints and let him go?

Answered by attorney David L. Leon
Immigration lawyer at David L. Leon, P.C.
You should probably pull a background check and FOIA request to see what's actually on his record. Most law offices will do this for a few hundred dollars. Once you see what's actually on there, then you can decide what to do.

Are there any new laws or ways to petition to become a permanent resident?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
Immigration just came out with a new policy that will allow certain young people to apply for a temporary work permit every 2 years. To qualify for deferred action (removal) under the new immigration policy, one must: 1. Have entered the US before the age of 16, 2. Have been physically present in the US on July 15, 2012, and continuously resided in the US for at least 5 years prior to the new policy, 3. Currently be in school or graduated from high school, or got a GED, 4. Have not been convicted of a felony, serious misdemeanor, or multiple misdemeanors, and 5. Be no older than the age of 30. The new policy will not come into effect for another 60 days. At that point, I will be able to tell you what the procedures are and what the cost will be.
