What if my wife came in the US with a B2 visa and overstayed?

Just tell CIS your wife is out of status. That will not affect your application and it will not affect her either.

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. (S)he would then be in a better position to analyze your case and advise you of your options.

What is my Classification of Status if I entered the US from Canada via land and was simply "waived in"

Answered by attorney Alan Lee

If you passed the inspection point by car and the immigration officer only waved you through without marking your passport, you could conceivably state that you entered as a B-2 visitor since you were coming for a ballgame.  You can also attach a sworn statement concerning your entry along with any documentary evidence of your trip on that date including such items as toll payments, gas receipts, etc. Then it will be up to the U.S.C.I.S. officer handling your case whether to believe that you entered the US with inspection.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
