How can i get a pardon for my husband who is in jail and charged with a felony and has a petition for permanent residence?

You say that you have already petitioned for your husband's permanent residence. The question is whether you filed for his I-130 relative petition and if he has filed an I 45 application for adjustment of status. If he was able to do that, you might be able to apply for a waiver in the event that he is convicted depending upon the seriousness of the felony and his equities. Such a waiver would depend upon establishing extreme hardship to you or to any sons or daughters or parents who are US citizens or permanent residents. In the event that he entered the US without inspection and cannot adjust status in the country, it is likely that he would have to be returned to his home country and he would have to consular process his immigration. At the interview for an immigrant visa, he would be refused and informed that he could apply for waivers. He would then have to apply for waivers of the crime if convicted, illegal presence in the US, and removal. While the adjudications are made by U.S.C.I.S., he would have to remain outside the US. Your father's situation is complicated and cannot be analyzed on a Question Board. Recommend you pay for a consultation with an experienced attorney to properly advise you and him.
