Will applying for Medicaid affect my removal of conditions on green card?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
You need not worry. If you applied for Medicaid or other public benefits, there could have been problems with your application for removal of conditions. But when your U.S. citizen husband applies for public support, there are no implications for your I-751 petition, at least, so long as you have a viable co-sponsor.

What can I do to get a green card for my husband if he was only 9 months old when he was brought here illegally?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
Unless he is 245i protected, he cannot adjust status in the US. I suggest you file I-130 and I-601A waiver. If the waiver is approved, he can return to his home country to receive immigrant visa if I-130 is also approved. Alternatively, he can file DACA to receive employment authorization and to keep his status in the US. If the relevant immigration law changes, he may be able to adjust status in the US without leaving the US. Your case is not a simple one so please consult immigration lawyer for help.

If I petition I-130 for my brother in the Philippines, how long is the waiting time?

Answered by attorney Carlos Raul Juelle (Unclaimed Profile)
Immigration lawyer at Herrera & Juelle LLP
It will take 1-2 years for the approval. However, they are currently processing for an immigration visa beneficiaries whose visa petition was filed on or before April 22, 1990. As such, your brother and his family would be waiting a long time, perhaps 24 years or more, until he and his family could immigrate to the United States. Any children included in the petition would likely turn 21 and age out of the petition.
