How can I leave my husband without him losing his green card?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
He can apply for a waiver. There are two types of waiver available. It sounds like he may qualify for one of them.

Will I still be able to get my green card?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Even if your husband divorces you at this time and your case is still pending, U.S.C.I.S. would give you the opportunity to amend your I-751 to another category such as having been in a bona fide marriage which is now dissolved. You would notify U.S.C.I.S. of the development once you divorce, and U.S.C.I.S. would reclassify your case. You would not have to refile if your case is still pending.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. I was denied entry to the US nine years ago at the border. I know they will ask me about this, will I be able to cross now?

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
If you were merely denied entry because of immigrant intent, that would not prevent you from applying for admission again at the border (in this case, at the airport in Palm Springs) at another time.  If you have a travel itinerary for your travels in the US, that will help the border agent confirm you are in fact coming as a tourist.
