Is it a problem to apply for a green card when the wife is older than her spouse?

Answered by attorney Marie Andree Michaud (Unclaimed Profile)
Immigration lawyer at Marie Michaud, Attorney At Law
Tell your correct age when applying for your paperwork. You have to provide a copy of your birth certificate and other documents such as the passport you used to enter the US in your application package, which show your real date of birth. I have successfully adjusted many couples where the Wife was a lot more than 5 years older than the husband. You must , like any couple of any age, document your relationship for the interview day (Example: Joint bank account, joint insurance, photos, etc.). Good luck.

Will my wife be banned from the US if she surrenders her green card?

Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
If you move outside the US, your wife does not need to relinquish her permanent residence. She may have difficulty in keeping it if she doesn't return every 6 months and have other significant ties to the US. Is she eligible for citizenship? That is only taking about 4-5 months.

What will happen to my brother green card situation if they get divorce?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
If you have petitioned for your brother his divorce will have no effect on his application but it will mean his ex-wife can no longer immigrate through your petition. Any of their children would still be eligible to be included if unmarried and under 21.
