Am I still allowed to stay if we cannot finish the paperwork before the due?

Answered by attorney Kevin L. Dixler

This gets complicated, so the answers may vary. First, if you did not extend your work visa, then there is no grace period unless you just graduated university in the last 30 to 60 days. Second, once you 'properly file' for adjustment, then you are in status. Some applications are rejected or delayed due to applicant oversights. If you travel while an overstay and are discovered, you 'may' be served a notice and complaint for deportation. This means that you must appear in immigration court. If you are subject to the J1 2 year residence abroad rule, you cannot adjust status unless a waiver is granted.

I'm 20 and I been in the US since 1 year old and I haven't fixed my papers how can I be a resident of the US?

Based on your facts, if you completed school here and have not been convicted of a crime that would make you ineligible, you may qualify for Deferred Action for Childhood Arrivals (DACA), which would give you a work permit and legal status that you may renew every 2 years. Once you have been granted deferred action, it may open up other paths to your residency.

Will a misdemeanor domestic violence 7 years ago be grounds for denial on being a sponsor for a k1 visa?

If you have a conviction for domestic violence, you will have to submit certified court records and police records showing the disposition of your conviction. Because of the nature of your crime ( domestic violence), if your petition is approved the information you provide about your convictions will be shown to the beneficiary of the K-1 visa. If you have filed for a K-1 visa before you may be considered a multiple filer and have to apply for a waiver of the criminal conviction grounds. Work with an experienced immigration attorney to guide you through the process.
