Should I still hope for a good outcome ?

Answered by attorney Alan Lee

You should probably wait out the process if you wish a life in America. Although there is no guarantee that the waiver will be approved, being married to a US citizen for eight years usually provides grounds to satisfy the hardship requirement of an I-601 application. Having a good lawyer to assist in preparing the application also usually helps. Do I need to obtain a fiancé visa to marry my fiancé who is a British citizen in the US

Answered by attorney Alan Lee

If the alien is in the United States, a fiancé visa is not required. You can move directly to filing for the green card. A fiancé visa is utilized where the alien is outside the United States.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Can a US citizen marry an immigrant in another country and return to the US?

You can either file for a K3 visa for your spouse, or consular process an immigrant visa. Either way, your spouse should be able to join you within a year. Best of luck.
