If there is a loss of residence status, is deportation eminent?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
I am sorry to hear of your financial difficulties. At the time you decided not to petition to remove the condition, an immigration attorney could have advised you about these very foreseeable consequences. It would be wise for you to engage an immigration attorney at this point to learn the relevant details and circumstances in order to be able to advise you about eligibilities, options and strategies, including for example initiating a new Adjustment of Status process. If you delay, and if Removal Proceedings are commenced, the process will become significantly more complicated and expensive.

How do I get papers to become an American citizen?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If any of your children are aged 21, they could perhaps sponsor you for permanent residence. Other than that, there is too little in your fact situation to give an opinion as to whether you be able to receive your immigration papers in the future. I suggest that you should consult with an immigration lawyer to go over your options. Asylum case

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
There is a good possibility that the asylum office will not issue a notice to appear (NTA) in the event of denial for you to appear in an immigration court since it appears from your question that you were legally here at the time of your interview. You would be able to file a motion to reopen or reconsider with the asylum office if you believe that the legal basis of denial was incorrect. If you were already illegal at the time of interview and an asylum officer was not convinced of your asylum claim, he or she would likely issue the NTA for you to make your case with the immigration court.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
