Green-card Holder Filing I-130 and I-485

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If you are sponsoring your wife under your green card status, the priority date of the I-130 petition must be current for visa availability and she must be in valid nonimmigrant status to be eligible for the I-485 to be filed. If not, she can either return or wait for you to become a U. S. citizen. Upon your citizenship, her category would change to immediate relative, a preference which is always available, and her overstay would not prevent her from filing an acceptable I-485 application. Marrying a DACA recipient

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
It is difficult to know what your qualifications are to stay in the US without more. Marrying a DACA recipient does not give you the right to live with him in the States. I suggest that you seek a consultation with an immigration lawyer who can go over your options. If I am a disabled person will I be able to sponsor a foreigner to take care of me?

It may be possible, but it is a long process taking several years for the permanent residence to be approved. What is your friends medical or rehabilitative background as he/she may qualify for a non-immigrant visa, which is faster.
