It is ALWAYS IN YOUR BEST INTERESTS to use an experienced immigration attorney as a mistake can end up in a denial of the case, or even worse - a person winding up in removal proceedings. If you do not want to hire an attorney to prepare and file the papers for you, at the very least you should have a consultation with one. The cost for this consultation should be well worth it. I do them in my office by telephone for clients in other parts in the US or are unable to make it into the office. Good luck.

It sounds like you misrepresenting a criminal issue to DHS. You need a competent immigration attorney to look at two items: the misrepresentation and its bar; and also to analyze your conviction to see if it has any bars as well. If you cannot locate someone there, have your son seek a full consult in the US. He will want to have your criminal record from the court and a copy of any immigration documents that you have, in regards to your immigration history (entry dates, status, etc.) and deportation.

It's not a guarantee. He would need some path for a visa. For example, if a hospital sponsored him for an H1B, he could stay in the USA under that visa.
