Please clarify what you mean by "he was approved on his petition." Do you have an approved I-130 and is your father still alive?

I-212

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
A service center filing producing a MSC receipt is usually available only where your party is also filing an I-601 waiver of fraud or misrepresentation.  In that case, the time for waiting would likely be 6+ months.  Without the need to file the I-601, your party should be filing the I-212 at the local CIS office with jurisdiction over his/her place of removal proceedings.  There is no set timeline for I-212 adjudication from a local immigration office although this type of adjudication can usually be done within a year. A standalone I-212 must be filed at the local immigration office where the removal proceedings were conducted in situations like yours where the applicant has been refused for an immigrant visa at the American consulate or embassy. What steps could I take to stop the deportation?

Answered by attorney Yahima Suarez (Unclaimed Profile)
Immigration lawyer at Hernandez & Suarez, PL
Your husband may have a chance if he can vacate the sentence on the drug charges in criminal court. This needs be done quickly as the immigration case will not wait. For immigration purposes, any charge of drugs more than "possession under 20 grams" has no waiver. Meaning, under immigration laws he would have no chance. His best bet is to try to fix his record through the criminal court. It is recommended you hire an experienced attorney to handle this matter. This is not a simple case and may have other complications. The above is only general information and shall not be construed as legal advice. It is always recommend you consult with an attorney to review all the details of your case.
