Should I leave when my visa ends?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
You can certainly stay while the case is pending. Assuming that the I-130/I-485 were filed before you fell out of status (it seems from you query that this is the case) then you have not accrued unlawful presence. If the case is denied, you should immediately seek the legal advice of a competent immigration law professional to try to get the case reopened. Alternatively, you may be able to re-file the case.

My daughter got US green card with my ex-husband, can I apply visa to the US?

Probably not. You would need someone to petition you, such as a family member over the age of 21, a spouse or a business. Without any one of those, immigrating to the U.S. would be extremely difficult.

If you are legally married and the marriage is a bona-fide one, you should have no problem. Work authorization cards usually take about 3 - 6 months for processing.
