What do I do if my I130 file is not moving

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
If your Priority Date is not current - this is not a bad thing as it gives more age out protection to derivatives. If your case is current then call the Customer Service number.

Does it make any difference in petition if spouse is here in USA to visit for a month?

Answered by attorney Sufen Hilf
Immigration lawyer at Hilf & Hilf PLC
If you file I-130 petition for your spouse and you are a permanent resident only, it will not give your spouse any legal status to stay in this country before the priority date becomes current. However, it may make a difference if you are close to apply for citizenship. Please contact a lawyer.
