Would this situation be consider a removal?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
As you received your permanent resident card the year following the refusal of your admission, you were not removed from the country. A removal order would bar you for 5 years if in a summary removal process, and 10 years in the regular process. Removal orders also come with a plethora of paperwork to allow you to understand that you have been removed. So your situation would not be considered a removal.  Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. If we marry in Mexico, can my boyfriend go back to US on a spouse visa?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
His chances depend on the exact circumstances of your case. But besides filing and getting your I-130 petition processed, he will also need to submit a I-601 waiver for the 10-year bar because he had left the country after having been unlawfully present in the United States in excess of 1 year. In order to get the waiver approved, you will need to submit substantial evidence to prove that you would suffer extreme hardship if he was not allowed to return immediately.

For citizenship, generally, no. For a relative visa petition, not directly, but maybe when it comes to affidavit of support.
