Adjustment of status

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
Your mother could petition for you, but you would have to process your immigrant visa outside of the US and when you leave, you'll be barred from returning if you overstay your current visa by too long.   A waiver is available.  Of course, marriage to a US citizen would allow you to stay here and become a permanent resident (assuming you entered the US with inspection).

Can I leave the US and come back with a piece of paper as a student or as President Barack Obama's immigration?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
I will assume that you are not a legal F-1 student as most American consulates will not give student visas to children who are 11 years old. If you are not legal, you should not do anything at this time. If you leave, you will have a very difficult time coming back in legally. You should wait and see what happens with the expansion of the DACA program which is presently on hold due to a temporary injunction by a federal district court judge in Texas. As you have already been in this country for five years and four months, and are presently studying, you would likely be eligible for the expanded form of DACA once the temporary injunction is overcome and the program put back on track. My husband had deportation, government decided to reopen case, he had a criminal case in the past

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The law against representing oneself as a US citizen when one is not has been in the immigration law a long time, but prior to the Illegal immigration Reform and Immigrant Responsibility Act of 1996, individuals were able to obtain waivers where this occurred. The law was changed so that there can be no forgiveness for such misrepresentations since September 30, 1996. As you know, all persons born in Puerto Rico are US citizens. If your husband represented that he was born in Puerto Rico, he would run afoul of this law. The question is whether he made the misrepresentation for a purpose or benefit under the state law.  Your attorney should explore the issue.
