How long do my parents have to stay in USA before they can leave without losing their green card?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
That is not really the right question. They are lawful PERMANENT residents. So the intent is that they will live in the US. Regardless of the 180/365 rule, DHS really is looking at a pattern of practice. How much time in a year are they in the US? Where is their employment and house? Where do they pay taxes? I recommend that you set an appointment for them with a competent immigration attorney in your area once in the US. They need to go over their fact pattern and long term travel goals so the attorney can outline the law and see what options are available to protect them. Make sure to ask about the reentry permit.

What do I have to do if I want to marry my boyfriend who lives in Mexico? Is it easier to marry there then bring him?

That's always the million dollar question. There is no simple answer, and there are a variety of options. We always sit down with a client to get all of the facts and then review the options with them, to see what works best.

Can we change our status with B1/B2 visa holder?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
One may enter the U.S. on a B1/B2 visitors or tourist visa only if one has the intent to enter the U.S. temporarily and then return abroad. Entering with the intent to promptly file to adjust status to become a Permanent Resident (to get a "Green Card") is likely to be determined to be "visa fraud," which can have very harsh consequences. It may be permissible, however, to enter the U.S. with a genuine intention to stay temporarily, but later decide in favor of seeking to become a Permanent Resident, but as you can see, details about this can become complex and problematic. There is no substitute for engaging an immigration attorney to learn all of the relevant facts, including your goals, and then advise about eligibilities, options and strategies. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.
