Can I help my boyfriend get immigration papers before getting married?

Answered by attorney Isaul Verdin (Unclaimed Profile)
Immigration lawyer at Verdin Law
First, you need to get married. Then you must file a family petition for him. I would consult with an immigration lawyer to see if he has a basis to seek 245i grandfathering so he can obtain a green card from within the U.S. It's important to inquire about this possibility. If he is not 245i grandfathered, then he will have to process his green card through the US consulate in his native country. In addition, he will have to file a waiver. Remember, please contact an experienced immigration lawyer before filing any form. Best of luck.

What do we need to be able for my fiance and I to be married in the US?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
To get married in the US, you normally must apply for a marriage license and present valid government issued identification such as a driver license, a state ID card, a passport, or other picture IDs. The exact requirements vary from state to state, so you should contact your local county clerk office for more information.

If that is his only violation; if you are a US citizen and marry him, then you can petition for his permanent residence.
