Is this marriage fraud and will I be deported?

Answered by attorney Carlos Raul Juelle (Unclaimed Profile)
Immigration lawyer at Herrera & Juelle LLP
You should be able to fix your papers and remain in the US. As far as fraud, that depends on how long ago you came into the United States.

Will my previous citizenship, age gap will affect my application for K1 visa for my fiancee?

default-avatar
Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
That is not a significant difference in age. Your previous citizenship should not be material to the K-1 petition. For a family of 5 (you, three children and your current fianc), the minimum income is approximately $33,000. The basis for your previous permanent residence may be a question; but if you have not filed for anyone else, and you can prove up the bona fides of the relationship, your K-1 should be approved.

How can I petition for my family to get citizenship?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
Unfortunately if you are adopted and obtained immigration benefits through your adopted family then you have no relationship to your biological family that would allow you to petition for them. Hopefully your father's sister if she is a U.s. citizen filed a petition for your father many years ago if not we can assist you with that (sibling of U.S. citizen FB-4 category). That process is lengthy but it would eventually allow them to come as permanent residents. They may also be able to come in another category but I would need to assess that to advise you properly. We would be happy to assess your case, advise more specifics on the procedures, timing and fees if you want to set up a consultation (in person or by phone) with me as indicated below. We do charge for consultation but the consultation fee is then credited 100% toward the fees for your case.
