Does he need to expunge the misdemeanor charge before filing for residency in the US?

Answered by attorney Bruce A. Coane (Unclaimed Profile)
Immigration lawyer at Coane & Associates, PLLC
Expungement does not void the arrest for immigration purposes. I would be happy to meet with you to review his records and analyze them for you, in terms of whether the arrest will prevent him from getting a green card. Either way, no reason to delay the filing of an I-130.

Can an employer disclose immigration status, legal or illegal, to the entire company without the prior consent of the individual?

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
That issue would be governed by state law where the company is located, and by company policies. It is unlikely there is a specific statute in Michigan, assuming that is where the company is located, that protects the privacy of someone's immigration status.  The documents showing someone's status may well be protected from release.  But it sounds like in this case, it was just someone with personal knowledge sharing that knowledge with others--no exchange of documents from the employee's file took place.  In any case, it would be advisable to consult with an attorney in Michigan to learn more.

Do I need to resubmit the I-131 and I-765 forms again when I renew my green card?

default-avatar
Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
Since you have a green card already, you no longer need to submit forms I-131 and I-765 when you renew your card. If you need to travel abroad for an extended period, then you will need to apply for a reentry permit on form I-131.
