Dear Naheed, I am a Canadian immigration lawyer, and can provide general information on the Canadian element of your question. Before taking any action on a Canadian immigration application, it is wise to request a copy of the old application and government file under the Access to Information Act.  One should know precisely what occured with the last application, and determine if there were any errors on it that should be explained in the new application. Foreign nationals who have committed a criminal act or have a conviction outside Canada that would be equivalent to a federal crime in Canada, may be criminally inadmissible to Canada.  Anyone who may be inadmissible can retain a lawyer to do the following: 1) analyse the act, conviction, foreign legislation vis-a-vis Canadian legislation.  2) if there is an equivalency, determine if it is "criminality" or "serious criminality", as these are defined under Canadian law.  3) calculate the date on which the foreign national could be "rehabilitated" (a determination by an official that the person is no longer inadmissible).  It may be five or ten years following completion of the sentence, depending on whether the crime was criminality or serious criminality.  4) examine whether a Temporary Resident Permit (special authorization to enter Canada while still inadmissible) is feasible.  5) assess the likelihood of success considering all the circumstances of the case. In short, criminality can make a foreign national inadmissible to Canada; however, sometimes that can be overcome.
