Am I eligible to file my naturalisation under the 3 years of marriage?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
Yes. If you remain married to your US citizen wife, you can apply for naturalization after you have been a legal resident for at least 2 years and 9 months. The application is filed on form N-400 and the fee is $680. In addition, you will also need to submit a copy of your green card and your joint tax returns for the last 3 years.

Many factors go into each and every case. You would need a full case review with a qualified Immigration Attorney BEFORE an answer can be given. You would be best served by speaking with one of us prior to the interview.

On the I-129 form, it gives the option for my alien fiance's U.S social security number, what do I put down?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
Most likely, your alien fiance does not have a Social Security number (unless he had been working in the U.S., with USCIS authorization, before). If so, write "none" in the appropriate section of the form. G-28 is the form that your attorney would submit. Since you don't have anyone representing you, leave that section blank or write "n/a" in it.
