Am I A US CITIZEN

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If you were adopted at the age of 2 by a U. S. citizen, but never became a permanent resident, you would not likely be a U. S. citizen by your adoptive parent as adopted children in the past had to be adopted while under 16, admitted for permanent residence, have had 2 years of residence in the legal custody of the adoptive parent and be under the age of 18 at the time that the naturalization petition was filed. You would also not likely be a citizen by virtue of being born out of wedlock and your biological father never legitimating you as the law from the time of your birth until you were 18 required that there be proof of your father’s physical residence in the U. S. or a U. S. possession or during military service for 10 years prior to your birth, 5 of which were after the age of 14, that he agree in writing to support you until the age of 18; and that paternity be established and he legitimate you, or acknowledge paternity, or have paternity established by court adjudication. What is the easier way for us to apply for change of status?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
You question is not really clear. We think that you mean that you will be applying for Adjustment of Status and that your husband is a USC. If his income is sufficient then he should do the I-864 and submit with the package.

Is there a way for me to keep the petition moving even if my wife does not want to be a part of it?

Immigration lawyer at Francis John Cowhig
Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.
