Domestic violence convictions can bring much trouble to immigration cases, but it is difficult to state anything one way or the other about your husband's situation as there are not enough facts to make an assessment. However, the fact that the interviewing officer said that she did not care about that case and that everything was going to be fine is a good indication that it may not be a determining factor. It is standard practice for any case involving crimes to be reviewed by a supervisor before final adjudication. It depends on the facts of the case, but the difficulty is that he has been deported already and he has 3 DUI charges. This fact scenario will likely have the AMCON CONOFF refer him to a panel physician to determine if he has an alcohol addiction or dependency. If he does, then that is a ground of inadmissibility.

The Child Citizenship Act (CCA) of 2000 states that if a Permanent Resident becomes a US Citizen, any child who is also a Permanent Resident and is under 18 years of age at the time the parent naturalizes, that child automatically becomes a US Citizen. You can then file form N-600 to apply for a Certificate of Citizenship for your child or apply to the State Department for his passport.
