It depends upon how you entered the country. If you came with a visa you should be ok. If you entered by illegally crossing the border you may have to leave. You need to have your case evaluated by an immigration attorney.

An I-130 petition can certainly be filed and approved. That's only the first step, and it gets more difficult after that.

As long as her I-90 has not expired, she should be fine. However, I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your case.
