I am on f1 visa and i got an offer for being an instructor but for full time non tenure track in university but it is gonna be per semester,

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
The instructor position would have to require 4-year degree and you must have the degree that the position requires before you could qualify for an H1B1 visa.  Right now, there are no H1B1 visas available.  They won't open up the numbers again until next spring.  So you wouldn't know whether you get one of the available visas until later in 2013.  Often, that waiting period makes changing to H1B1 status a difficult task.

If you marry your fiance, you can file a petition for him to become legal. The process takes about 6 months to a year, provided you have all of the supporting documentation.

Can I use a co-sponsor to petition my fiancé?

Aleksandr Y Troyb
Answered by attorney Aleksandr Y Troyb (Unclaimed Profile)
Immigration lawyer at Benjamin, Gold & Troyb, P.C.
Technically you can use a co-sponsor in addition to you acting as a primary sponsor. In fact, one of our clients recently used a co-sponsor for his fianc? in Peru. Having said that, I have seen reports that some embassies do not accept affidavits from co-sponsors. You may be able to use your assets in the event that your income isn't sufficient to meet the USCIS thresholds. I would advise you to contact an immigration attorney if you are concerned about the sufficiency your income.
