A simple petty offense arrest without conviction should not prevent you from re-entering the US with a valid LPR card. It should not prevent the removal of the conditions on your 2 year card if your marriage is bona fide. You should consult an immigration attorney.

It is imperative that you consult an experienced immigration attorney to discuss your spouse's case. The criminal record from IL will most likely result in a finding of inadmissibility and the need for a waiver. The law in this area in complex and difficult to navigate as a pro se applicant.

The difficulty of entering the country without inspection is that you will not be able to adjust your status to permanent residence here in the country unless you have the benefit of §245(i) under which individuals can adjust status even though illegal upon payment of a fine amount so long as they had a labor certification application or I-130 petition filed by April 30, 2001.
