Are we going to run into any problems getting married since he is not a resident or citizen?

Answered by attorney Myron Russell Morales (Unclaimed Profile)
Immigration lawyer at Quan Law Group, PLLC
Normally there is no problem with getting a marriage license and going through the ceremony. Once he is married, the inspectors at the border may begin to question his intent if he tries to enter as a visitor or non immigrant. I would suggest going through either an adjustment of status or consular process to make him a resident once you are married. Both processes can take 8 months to a year or more.

Please what do if my new Nigerian husband married me to become a citizen of America

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Given your situation, you may consider stopping his immigration case if you have already started it if you believe that your marital situation is hopeless. There would seem to be little point in helping him to attain his dream life in America without you. Then your husband will do whatever he thinks will get him the green card and money anyway. The immigration laws of the US in dealing with marriage related applications contemplate a bona fide marriage in which the couple have every intent of establishing a life for themselves together in the country. My Italian fried is marrying a US citizen; if she then wants to divorce will she lose her green card?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
Immigration lawyer at Francis John Cowhig
Possibly, depending on how long the marriage last. In order to obtain her 10 year green card, she must remain married for at least 2 years. If the green card interview and grant of permanent residency prior to their 2 year wedding anniversary, then she will receive a "conditional" green card and must remain married for an additional 2 yrs from the date of the conditional green card. If the interview is after their 2 year wedding anniversary, then she would receive a regular green card without any conditions. If it is a legitimate marriage and not one for the purpose of obtaining legal residency (Sham Marriage), there may be waivers available to her if the marriage does not work out.
