Deferred action is still available for everyone on a discretionary basis, but if you want to qualify for deferred action under DACA (Deferred Action for Childhood Arrivals) you can be no older than 30 years old.

Yes, you can enter on the H-4 as long as your spouse or parent is maintaining H-1B status. It does not matter that the B visa was not cancelled. You can hold two valid U.S. visas at the same time.
