I want to petition my wife how long does it take to approve her papers?

Answered by attorney Marie Andree Michaud (Unclaimed Profile)
Immigration lawyer at Marie Michaud, Attorney At Law
The first step involved family petition. It takes about 5 to 6 months for it to be approved. Once approved the USCIS will transfer the file briefly to the national Visa Center. A few days later the national Visa Center will transfer the file to the US consulate in Manila. The interview is supposed to occur within four months of the petition approval, but sometimes, delay occurs. Most of my clients complete the process in about 9 to 11 months. I hope this helped.

Probably the best thing you can do is to write to the applicable USCIS field office where the interview will be conducted or the US Consulate if the interview is to be overseas giving as complete details as you can concerning the intending immigrant and the petitioner. You may also wish to send your correspondence by certified return receipt to keep a record of when the appropriate agency received your withdrawal notice. How can I help my fiance obtain a permanent visa?

Answered by attorney Eric M. Mark
Immigration lawyer at The Law Office of Eric M. Mark
Once you are married he can apply to adjust status. He should avoid overstaying his visa by getting extensions or marrying and adjusting ASAP. It would be wise to consult with an immigration lawyer for a more in depth assessment of your situation.
