In a marriage-based adjustment of status application in the Immediate Relative visa category, the foreign national's previous criminal offenses must be revealed to the USCIS, and the foreign national spouse should plan to supply to the USCIS a full set of court-certified case disposition documents. With that, the traffic offenses should not stand in the way of eligibility to become a Lawful Permanent Resident (to get a "Green Card"). Note that improper completion of the application or the supplying of insufficient supporting documents can cause substantial delay or even more harsh consequences, and it would be wise for you and your husband to work with an immigration lawyer.

Generally, a U.S. citizen may sponsor a spouse with a Form I-130 application regardless of when and how the citizen spouse became a citizen and regardless of whether the citizen spouse has a felony conviction. The USCIS generally accepts a U.S. passport as evidence of U.S. citizenship. Of course, there are many other details that determine eligibility for a marriage-based adjustment of status application. It would be wise for you and your spouse to consult with an immigration attorney who, after learning all of the relevant details, would be able to advise about eligibilities, options and strategies, and would be able to offer legal representation in the often complex application process. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

The USCIS generally recognizes a marriage to be valid if it was valid where the marriage took place. When a U.S. citizen spouse inappropriately files a tax return by which she swears that she is not married, that indeed can create significant problems, but usually that can be solved by filing an amended return and by being prepared to explain why the error was made in the first place. It would be wise for you and your husband to work with an immigration attorney, especially with the complications you mentioned.
