You should be able to file the I-485 with a copy of the receipt notice for the I-130 OR you can just refile again the I-130 with the I-485 if the first plan doesn't work.

You still have to process her immigrant visa application with its supporting documents at the national Visa center. The time of the process depends on who is handling the case.

If you passed the inspection point by car and the immigration officer only waved you through without marking your passport, you could conceivably state that you entered as a B-2 visitor since you were coming for a ballgame.  You can also attach a sworn statement concerning your entry along with any documentary evidence of your trip on that date including such items as toll payments, gas receipts, etc. Then it will be up to the U.S.C.I.S. officer handling your case whether to believe that you entered the US with inspection.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
