What can we do to get a refund?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Unfortunately U.S.C.I.S. will not give back a refund under the circumstances that you described. It would point out that it did nothing wrong, accepted your applications, and put both of them through processing. It would say that if there was any fault, it was yours or your parents, and that it is entitled to keep the fees.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Can my wife travel outside the US while waiting for H4 change of status approval?

Answered by attorney Bruce A. Coane (Unclaimed Profile)
Immigration lawyer at Coane & Associates, PLLC
If a person applies in the USA to change status, and then they leave the USA while the application is still pending, they are deemed to have abandoned the application. Of course, a person can leave and simply apply for the H-4 status at a USA Consulate.

Do I have a chance to petition for him or will he automatically be denied if he was still on trial and he left the country?

You can always file a visa petition if you're a U.S.A. citizen. No guarantee he gets a visa, but you can certainly file.
