It should not create any problem - so long as you do not need to count the people placed through your staffing company as your employees.

Should I marry him and apply through him or renew my DACA which is up in about 11 months?

Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
It depends on your situation, but legally you can do both. You can continue to renew your DACA work permit every 2 years and while that status is still valid, you can marry your boyfriend who can then file an I-130 petition on your behalf. Because you last entered without inspection and have been unlawfully present in the US for more than 1 year, you are not eligible for adjustment of status and must apply for a provisional waiver and get it approved before departing the US for your visa interview at the US consulate.
