How long does it take to sponsor a sibling over 21, married in the US?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
Your mother cannot sponsor you unless she becomes a U.S. citizen; if she becomes a citizen and files a petition for you, your turn to receive a green card will come in about 11 years (plus waiting for an interview at the U.S. Consulate will take up to a year). ON your sister's petition, your turn for a green card will come in about 12 years (plus about a year for the consular processing) If everything will be done right, your husband will receive a green card together with you. If the immigration law does not change, after receiving your green card, you will be able to file petitions for your children who will be unmarried at that time (to sponsor your married children, you would have to be a U.S. citizen). There is no way to predict what the waiting time for green cards will be 12-13 years from now. Besides, the U.S. immigration law willl likely change more than once during the same time.

Once I get married and I report my change of status to the immigration office, does my green card application become void?

It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. Are you marrying a U.S. citizen? Green card holder. Someone from your home country. Is your father a U.S. citizen or green card holder.

Can my husband keep his green card?

Hassan Hussein Elkhalil
Answered by attorney Hassan Hussein Elkhalil (Unclaimed Profile)
Immigration lawyer at Elkhalil Law, P.C.
The custody issue is determined by either your mutual agreement or the court will determine custody. As to his green card, if the marriage was entered into in good faith and your husband can show that the marriage was entered into in good faith, he may be able to keep his green card.
