Designated Representative for N-648 Case

Answered by attorney Lelia Adams
Immigration lawyer at Essien Immigration Law, PLLC
Generally since your mother is currently her primary custodial caregiver and take responsibility for your sister the applicant is considered an authorized designated representative. She is in the States legally, is an LPR so there should not be an issue of representation.  Ensure attach document that establishes familial relationship between your sister and your mother as well as proof your mother is the primary custodial caregiver. I will strongly recommend you seek representation from an attorney  who can assist in reviewing and assemblying your application for you as he/she will assist you with confidence and all adequate pieces of evidence plus more.

If two US Citizens have a child abroad is the child still entitled to a US Passport?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The law only asks that one of the parents have had a residence in the US. The residence must take place prior to the child's birth, and the law does not define how long the residence must be. In saying that both US citizens have lived outside the US for more than five years, I assume that that means that you both resided in in the US at some point in the past. If that is the case, your child should be eligible for the US passport.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. If he left the US before the age of 18 he did not accrue unlawful presence and shouldn't be barred from entering the US for that reason.
